A major issue involved in resolving international disputes is jurisdiction. The United States has preset levels of jurisdiction- state and federal. When working with companies in another country it is helpful to define which laws are to be followed and in the event of a dispute, what form of resolution would be used. Having an understanding of what is and is not against the law as well as what offenses can be disputed it pertinent. Using local legal counsel should be taken into consideration as well. The local counsel will know the ins and outs of the legal system and present the facts in the best manner. A factor that could work against CardMex would be if they choose to go with a standard contract verses a very detailed contract. Not having all peculiarities covered means that the company did not take the time to think about potential outcomes and thus was negligent. This means the chances of having a conflict are higher since there is higher liability. Work hours and male or female representation are all conflicts that may arise.
