Section 1 – Know the employment rights and responsibilities of the employee and employer

1. Identify four main points that would be included in a contract of employment. If possible, use an example contract to support your answer (feel free to obscure any confidential information).

Main points included would be the employers name and employees details such as name and main place of work. Then there would be the employees job role, hours, duties and responsibilities, salary, holiday entitlement, sick leave entitlement and pension. Also included would be the companys confidentiality clause, how the employee can complain and also disiplinary and dissmisal procedures.

Main Place of Work: ABC Distribution services 123 Woodland Road Kings Heath Birmingham West Midlands B14 5EF Duties and Responsibilities: You will be answering phones, welcoming customers, checking and answering, correspondence, filing and paperwork. You may be asked to do other jobs from time to time similar to your job role.

Hours: 9am-5pm 5 days a week 40 hours per week

Salary: £22,000 per year

Pension: There is a pension Scheme

Annual Leave: You will be entitled to 3 weeks annual leave requests for annual leavemust be submitted in writing a 4 weeks in advance of the time requested.

Sick Leave: If you feel unable to come to work due to illness please inform ABC Diistribution Services immediatley so that appropriate cover may be seeked.

Confidentiality: ABC Distribution services will keep all employees details for personnel purposes we will comply with the Data Protection Act 1998

Complaints: We expect you to resolve any minor/personal issues you may have personally but if situations arise and you feel you are unable to handle it personally you hand in a written complaint to a duty manager and we shall try to resolve the matter as soon as possible.

Disiplinary Procedures: We expect you to resolve matters personally. More serious matters will result in ABC Distribution Services commencing disiplinary procedures as set out in the Companies guidelines.

Dismissal Procedures: If Gross negligence/mis-conduct there will be no period of notice give. If you are in your first year of employment or in a probationary period you are only given one written warning before dismissal.
