The United States Constitution was founded by men who understand that it is human nature for man to seek freedom; they realized that it is natural for the governed to rebel under oppression of a government that continually persists in interfering with their natural rights. The U.S. Constitution was founded to give the power to the people under the laws of the land, and to ensure safety, preservation, and procedure to organize this power. John Locke states, “We must consider what estate all men are naturally in, and that is a state of perfect freedom to order their actions, and dispose of their possessions and persons as they think fit, within the bounds of the law of Nature.” [1] The Constitution manifests this idea of the people being governed, with limitations to that power by the consent of the governed. In this state, men will be able to live in harmony, being able to follow their pursuit of happiness under the control of the government.
The Constitution provides checks and balances within the three branches of government to protect the equality of power. It is also necessary the three branches to work together because they, in and of themselves have a natural synergy with one another. But at the same time, the three branches of power should remain separate and distinct in the exercise of power, because the mixture of these powers cause for a dangerous accumulation of corruption. A specific way that citizens are protected from the danger of corruption is our right to vote for our Representatives. In Section 2, it states that the House of Representatives shall be composed of members chosen every two years by the people of the several states. This serves as a way to evenly distribute power to other people, without having one person holding power for too long.
The purpose of the constitution is to protect the freedom of the people, protecting the natural rights of life, liberty, and property while still having a strong government to balance power to keep order. Without the laws, the people would take advantage of the power that is given to them, and they could cause harm to others. If one were accused of breaking the law, all persons are to be put in trial by jury. The 6th amendment allows for a person to be able to have a counsel for his/her defense. In Article III section 3 it states, the Congress has to power to declare punishment of treason, but “no attainder of Treason shall work Corruption of Blood, or Forfeiture except during the Life of the Person attainted.” This is an example of the limitations of power of the Judicial branch, in other cultures if one person was a criminal, his/her family would have to forfeit their belongings to the state.
