In 1973 Roe v. Wade ruled “no state may prohibit abortion before the time of fetal viability based on a fundamental “right to privacy”” (MacKinnon 200). Why is this Supreme Court decision important today? Present at least one current example that demonstrates its relevance and discuss how an ethical theory we have covered addresses that example. Reflect on the example you have found. Do the persons involved present moral arguments that do or do not depend on the moral status of the fetus? How so?

Why is the Supreme Court decision important today? U.S. Supreme Court is important today because it is the last word in both policy and legislative disputes, meaning that it’s final. U.S. Supreme Court is the highest courts; they have the power to charge with determining the constitutionality of lower court rulings. It’s where cases that need another ruling or need to solved in a local court house taken to the highest nine justices, its where civil, voting rights disputed. One example of a current use of their powers is the decision that “Closes All But 8 Abortion Clinics in Texas.” The 5th Circuit of the U.S. Court issued a ruling reversing a U.S. District court’s decision that struck down as unconstitutional two provisions of Texas’ 2013 omnibus anti-abortion bill, House Bill 2 (HB 2. This ruling makes its hard for women to get approved for an abortion. According to Lucy Stein form ProgressTexas.org, “under this decision, all abortion providers in Texas must meet the physical standards for ASCs,( Ambulatory Surgery Centers) even though ASCs are only required by law for procedures that are more invasive and risky than abortion.”
Ambulatory Surgery Center is located in Texas, U.S.A. and for 30 years have been vital to helping patients have a safe and comfortable experience. Patients love the high quality of the centers and trust the work that they do there. Also Surgery centers charge patients fewer than hospitals and also makes co-payments and deductibles costs less. Many of the centers use a flat fee billing for each procedure, meaning that patients know how much an abortion will cost ahead of time and be able to make financial arrangements. According to texasascsociety.org a study was found that ASCs had an economic impact of $1.7 billion on the economy in 2009, have employed over 7,300 Texans and paid over $400 million in taxes. “The HB 2 contains three severe restrictions on abortion, including a 20-week abortion ban and a requirement that abortion clinics conform to the standards of ambulatory surgical centers. Only five the state’s ( of Texas) 42 clinics meet those requirements; the other 37 will have to quickly upgrade or close down”.(texasobserver.org)
This is an example of Utilitarianism, where in order to determine what is right, wrong, and good or bad we look at pass experience that happened when a bill was pass to ban abortion, like Roe vs. Wade. This ruling is going against the Roe vs. Wade and banning clinics the tools to perform abortions and forcing pregnant women to find other resources. This bill has brought both pleasure for women and men that are against abortion and feel that the fetus have rights and therefore should not be terminated. But this bill has also brought pain, to pregnant women who now have to drive miles to a clinic, and to the many physicals and employers that have lost their jobs due to clinics being shutdown. Also the Likelihood on how long this bill will be in effect, is unknown I know that pro- abortionist will fight this bill, and take it to the Supreme Court and whether it was the best decision for the state of Texas I don’t know.
