Within this writing assignment I intend to discuss the roles of law and courts in today's business environment, differentiate the federal court structure with your state's court structure, discuss the concept of judicial review, and explain how laws or regulations affect my present industry.
The role and function of law and the court system in today’s business environment is that of a mediator, peace keeper, and enforcer. “The roles of the judiciary are to (1) apply rules of law and principles of equity equally to settle cases and controversies, and (2) review the decisions of trial courts and the actions of the other branches of Venue is a determination of the most appropriate court location for litigating a dispute.” (S.P. Melvin, 2011)
In the case of my particular industry, my company is governed by state and federal regulations, as well as tribal, which falls under federal for the most part. This is an interesting subject matter for me as I work in the Regulatory and Compliance department of a major oil and gas producer. My role is that of a lawyer and policeman. I insure that all areas within my region are compliant to all state and federal laws as well as contractual agreements. I am also responsible for defending these areas when we are accused of noncompliance with one of these rules or regulations. I know first hand what it means to have to conform to the laws of both state and federal laws and regulations due the the fact that my industry is so closely monitored by both parties.
This course has really been eye opening so far as to how the law works between the two divisions of the judiciary. I look forward to the next few weeks and hope I can contribute more as we progress.
