Technically, marijuana is not illegal. According to the constitution of the United States of America, an amendment is need to prohibit the use of mind-altering substances. Clearly, there is no amendment stating the use of these substances, therefore, marijuana, or any narcotic for that matter, is legal. The current federal anti-drug law, the Controlled Substances Act of 1971, gets its authority from the Commerce Clause of the US Constitution, which gives the federal government power "To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes." (Article I, Section 8, Clause 3)The legalization of pot blatantly contradicts the federal government’s classification of marijuana as an illegal Schedule I substance “considered the most dangerous class of drugs with a high potential for abuse and potentially severe psychological and/or physical dependence” .
