ABSTRACT:
This paper will talk about and discuss the key points involved in the court determining the lawfulness of the use of force. I will also evaluate the level of objectivity inherent in each point that I have specified. Next, I will determine the fundamental difference between the castle doctrines and stand your ground types of criminal defenses. I will justify the validity of each, and provide one example of each to support my response. Also, I will analyze the overall role that double jeopardy clause plays within the trial system. Castle doctrine is known for not increasing violent crimes but is known for a legal doctrine that designates a person's abode or, in some states, any legally occupied place as a place in which that person has certain protections and immunities permitting him or her, in certain circumstances, to use force to defend themselves against an intruder, free from legal responsibility/prosecution for the consequences of the force used. (Definitions.uslegal.com, 2014) Stand Your Ground Law is referred to as a law that states that a person may use deadly force in self-defense without the duty to retreat when faced with a reasonable perceived threat. The laws expand on the “Castle doctrine,” which says that a person is protected under the law to use deadly force in self-defense when his or her property or home is being invaded. More than half of the states in the country have some form of “Castle doctrine” or “stand your ground” law on the books. (Usnews.com, 2014)
Double jeopardy originates from the Fifth Amendment in the criminal system means being persecuted or charged with the same crime for more than once. (Law.cornell.edu, 2014) An example would be getting charged with killing someone twice at different times. Double jeopardy in all around fair to me under every circumstance because I solely believe that if a person commits a crime at any given time they need to accept and to the time.
