MEMORANDUM
To: Shep Howard, President
From: Chante Procell, Risk Manager
Date: June 15, 2015
Subject: Simply Green Products and SafePack issue
This memo's purpose is to inform you of a potential risk to your company. Just Green Products (SGP) produces biodegradable packing materials. Just Green Products packages materials under the name "SafePack." since 2008. The name is on all of their packing material and followed the state and trademark federal protection (Safepack Industries Ltd, 2014). In recent times, due to more eco-friendly agricultural production, biodegradable packing materials are provided marketing advantage of the SGP above non-biodegradable competitors.

Moreover, the company president has recently become aware of the environmental issue and the intellectual property matter that may be solved by the corporation. For this section, discuss the environmental questions that have faced by the company. An environmental group is accusing SafePack of being non-biodegradable that are causing an environmental hazard. The group claims that these materials are seeping from a local landfill into a nearby stream that pollute and risk environment. An environmental group has established an Internet campaign geared toward compelling fruit producers to stop purchasing SGP packing materials to reduce pollution and protect the environment (Stanwick & Stanwick, 2009). This situation creates environmental issues regarding the Clean Water Act and the Solid Waste Disposal Act
1. For someone to prove a valid claim under, there must be elements that are specified under the laws regarding The Clean Water Act- 33 U.S.C. §1251 et seq. (1972) and The Solid Waste Disposal Act- 42 U.S. Code Chapter 82. The Clean Water Act (CWA) made it unlawful to discharge any pollutant from a point source into navigable waters unless had a permit. The Solid Waste Disposal Act- 42 U.S. Code Chapter, 82 Solid Waste Disposal Act, regulates the treatment, storage and disposal of solid, both non-hazardous and hazardous, waste. Solid waste includes the non-hazardous solid, liquid, or contained gaseous refuse generated by industrial, commercial and residential sources. Only Green Products does not violate any of the laws or have elements to prove valid.
, Simply Green Products produce biodegradable packing materials that orchards use in the Shenandoah Valley to transport their apples, peaches, and pears nationwide. The biodegradable packaging material is called Safecompos. This biopolymer paper/board offers oxygen, humidity, grease barriers and scalability. Bio-polymer coating comes from fossil sources and natural crops. The materials are environmental-friendly and are easily compostable in nature and does not accumulate as waste. Naturally Green Products received the World Star Award by the World Packaging Organization for their environmental-friendly material (Safepack Industries Ltd, 2014). I recommend the environmental issue because the company is in compliance with the specified laws of both the Clean
