Role of the United States Constitution

It is essential to have an orderly and uniform process of doing business in a society that is focused on achieving peace for its people. Most reasonable people will agree that orderliness conforms to peace which eventually creates a livable society. It is a good thing to have an orderly and uniform way of doing things but a greater thing for the orderly and uniform way of doing things to be implemented and achievable. In a society like the U.S.A., for example, peace and livable society is more achievable because of its Constitution. Cheeseman states that the Constitution of the U.S.A. was adopted in 1787 with the sole purpose of creating peace, harmony, and uniformity in the society. In the Constitution is the recommendation for business and commerce. The Wireless Company I work for, Verizon Wireless (VZW) is mandated with some constitutional obligations. Specifically relating to the U.S.Constitution and the United States legal system in business regulation, Article 1, section 8 of the Constitution and Amendment 1 relates to VZW. Article 1, section 8 states that: “The Congress shall have Power to lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defense and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States.” Verizon Wireless (VZW) is obligated to pay Federal and governmental taxes as recognized in the Constitution and the legal system. Established in 1934, the Federal Communications Commission (FCC) is charged with regulating wireless taxes in the U.S.A. The only imposed Federal and Governmental taxes required to be on VZW subscriber bills are Federal Excise Tax and governmental taxes applicable to the state and local taxes of the subscribers. It is important to note that these taxes are of uniform sourcing, which means there is appropriation to correct taxation. The Federal Excise Tax is a standard 3% on subscribers’ bills. The taxes are used for the common Defense and general Welfare of the United States. This is a uniform tax because it is the same regardless of where the subscriber is located in the U.S.A. The second mandatory tax to be on VZW subscribers’ bills is the state and local taxes. These taxes are imposed by state, local and municipal governments on VZW. VZW imposes these taxes appropriately by using the Place of Primary Use (PPU) of the subscriber. The PPU is the address associated with each wireless line at time of activation. It can be changed by the subscriber when he or she desires. For example, I live in the state of Ga, city of Lawrenceville, and county of Gwinnett and the state and local taxes of my VZW bill conforms with the taxes imposed by the state of Ga, city of Lawrenceville, and county of Gwinnett. Amendment 1 also relates to VZW. The Bill of Rights, Amendment 1 states that: “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.”
