The existed of crime has been heard of since early history of civilization. For centuries, societies have been establishing to safeguard residents from criminal activities with laws. Throughout the years, these laws must continuously be required in taking part in the attempt to uphold social order. One such law is punishment for those who act deviously. Actions of people deviant behavior have been a social issue enclosed by much disagreement throughout the United States. Those found guilty of deviant behavior have been dealt with through various forms of degrees of punishment. The United States justifies has four forms of punishment that is deterrence, retribution, treatment, and community safety. These procedures of punishment are the social order attempt to crease corruption in the world. This paper will explain in further detail the effectiveness these punishments have on society, to deter crime in which type of punishment is utmost efficiently, and so the penalties of retribution offer any benefits for criminal and civilization.
Justifying Punishment
Within the United States, there is practice of punishment requires a type of justification. This justification often involves impressive certain procedure of who breaks the laws or destruction and injury to individual or property. The fact following the application of punishment of an individual is not for it to hurt, but if the explanation is said that punishment causes good judgment. When a 14 year-old girl walking home from school is killed by a stray bullet, society becomes enraged. They believe that the individuals responsible for such a horrific act of violence must be punished. In situations such as this, people imagine the criminal fairness and the justice system to punish the offenders to the full degree of the law. The problems here are, who has the right to punish said individuals, and how much punishment is justified? This; however, increases societies questions about moral and ethical issues concerning discrimination and equality. Consequently, the concept of punishment affects those who behaved defiantly and those who decide what form of punishment needs to be applied.
Retribution
The first type of justification of punishment well known to society is retribution. Retribution, the oldest form of justification is defined by way of an act of ethical revenge by which people want the offender suffers as much as the suffering caused by the crime” (Macionis, 2006, p 182). Essentially, retribution is understood by many as “an eye for eye” or “do unto as they have done unto other”. According to Einat & Herzog (2011) “But people from different social groups within a given society with different culture to evaluate the seriousness of criminal offenses identically, regardless, of social, cultural, or personal variables. “Consequently, this form of punishment has been designed as a form of closure to satisfy and restore society’s needs and moral orders (Macionis, 2006). Retribution is the element of justice, which stands by those who abide by the law.
With punishment for murderers and rapists does provide society and the criminals consequences do not pay. It will keep those violence criminals from being on our streets. While the criminal is incarcerated they are pay for what they have committed along with being care for with housing, food, and other programs to help them in the process. With numerous crimes that are being committed everyday all around us we have to be concerned as criminals and non-criminals. The reason for say this is criminal is in danger from other that wants to punish them as more as the law has. Then there are non-criminals that are in danger from criminals and non-criminals, it just depends of the situation and past.
