Current Legislation for Home Based Childcare 1.1
There are many laws and legislations in place ensuring that the safety and well-being of children and young people are paramount, the main focuses of these laws are to ensure children are not subject to abuse or neglect in any setting and that they are provided with the best care and start in life as possible.
The Children act 1989 was the first legislation of its kind to state that children’s needs should be paramount and was the first to acknowledge that “children have rights”, it works with parents and care givers to ensure the safety and well-being of children and the provision of equal rights.
In 2004 the act was revised following an investigation into the abuse and death of 8 year old Victoria Climbié in 2000 which revealed numerous short comings of the system in her case, a public enquiry was launched to find out what children and young people felt most important, the following outcomes were added to the children act under the “Every Child Matters” legislation:
● Being Healthy: enjoying good physical and mental health and living a healthy
Lifestyle
● Staying safe: being protected from harm and neglect
● Enjoying and Achieving: getting the most out of life and developing the skills
For adulthood
● Making a Positive Contribution: being involved with the community and
Society and not engaging in anti-social or offending behaviour
● Economic Well-being: not being prevented by economic disadvantage from
Achieving their full potential in life.
Due to this legislation, all child carers and childcare settings are subject to OFSTED checks to ensure they meet their regulations and requirements to provide safety and well-being as well as ensuring children in their care will
