A democracy is born where the government’s power is in the hands of the people. The Framers of the Constitution established the fundamental idea of a democracy. Freedom after freedom was constructed into the Bill of Rights. In particular, one freedom is the necessity for the function of our democratic nation. The right to privacy is more of a privilege than a right in this nation. America became a beacon of hope and restoration to ensure that people had a freedom of speech allowing us to speak our minds especially regarding the right to privacy. We have to remember that the freedom of speech is not absolute. There are restrictions and limitations based upon its content, or the time, place, and manner in which it is given. We assume we can say anything we please, but that is not necessarily the case. An area of limitation on freedom of speech falls into the category of whether or not it is seditious. Seditious speech is speech that advocates the overthrow of the government. We have a right to talk about a government, to dislike our government, but that does not allow us to advocate others to take action of the overthrow of the government. For example, in the case Yates v. United States (1957), 11 members of the Communist Party had been convicted in lower courts after meeting to discuss the communist form of government. The Supreme Court said “the essential distinction is that those to whom the advocacy is addressed must be urged to do something, now or in the future, rather merely to believe in something.” The bottom line, you can talk about the overthrow of democracy, but you cannot advocate or urge others to take action. One big action I advise is to, think before you speak, to try and avoid limitations on your freedom of speech and your privilege of privacy.
