Crimes Against People Crimes that are committed against a person produce a material risk that an offender will threaten body injury or actually use physical force on a person. These crimes are compiled of, but not limited to, offenses such as murder, manslaughter, battery, and assault. Although stalking is considered a crime against a person, it does not require the threat or use of physical force. I will provide you with a more detailed overview of the above stated offenses and the respective punishments for crimes that are committed against people. The material covered will be as follows:
Murder- Felony Murder
Voluntary Manslaughter- Involuntary Manslaughter
Simple Battery- Battery-
Simple Battery- Battery-Aggravated Battery Simple battery is an offense that is committed when one individual intentionally incites physical contact or causes bodily harm to another individual. Simple battery is considered a misdemeanor under O.C.G.A. 16-5-23. Battery is when “a person intentionally causes substantial physical harm or visible bodily harm to another. This may include things such as black eyes, bruises and scratches that another individual other than the victim can see. Victims will sometimes use photos, police reports, or doctor's notes to prove bodily harm during criminal and civil court proceedings. Battery is also a misdemeanor under Georgia code 16-5-23.1. Under O.C.G.A. 16-5-24 “a person commits the offense of aggravated battery when he or she maliciously causes bodily harm to another by rendering a body part useless, or by seriously disfiguring his or her body of thereof.” Depending upon the type of victim (corrections officer, teacher, etc.) of the aggravated battery, punishments can range from one year to 20 years.
Simple Assault- Aggravated Assault Under Georgia code 16-5-20, a person has committed simple assault when violence is committed against a person or when an individual commits an act knowing that a person will likely receive a violent injury as an immediate result of their actions. Simple assault
