Scenario Two In this scenario Jeremy Atwater, a 17 year old minor, has entered into a contract with Smooth Used Auto Sales negotiating the purchase of a vehicle he intends to make payments on while working part time as a student. Six months after purchasing the vehicle, Jeremy loses his job and decides that he no longer wants the vehicle and wants his money back. There are two ways to look at this. One way is by recognizing that a minor can void a contract while he/she is still a minor or after a reasonable time after reaching the age of maturity which is 18 years of age. The law can find that Jeremy cannot void the contract if he waits past that reasonable time frame and does nothing to disaffirm the contract. If Jeremy continued making the payments after he turned 18 years old, then his actions ratified the contract making it unable to be voided. This would mean that Jeremy has to remain in the contract and is not entitled to his money back. The other side of this scenario is that a minor cannot enter into a contract with a seller of a product or service. Based on this fact alone, Jeremy’s contract with Smooth Used Auto Sales is void and holds no legal merit. It actually shows negligence on the part of the dealership because they failed to verify Jeremy Atwater’s age at the time of negotiation. Based on this, Jeremy Atwater’s money would be returned and Smooth Used Auto Sales would receive the car back. The sale of the vehicle is not for the purpose of business
