Answer: Something I learned about in Chapter 7 that I did not previously have knowledge of is the Electronic Communications Privacy Act (ECPA), which makes it illegal to intercept a cellular telephone conversation or disclose or air the communication with knowledge or reason to believe that the call was intercepted illegally; also prohibits the intentional interception of online communication and outlaws such practices as keystroke monitoring. This law also forbids the manufacturers and importers of radio scanners from making or selling scanners that can intercept communications on frequencies used for cellular telephones. Answer: Yes, some American courts consider it possible for a well-known person to pass his or her right of publicity on to an heir, due to the fact that many believe that the right of publicity is the most “intuitive of intellectual property rights”, but also has the greatest statutory confusion, some states that recognize the right do so differently, and some states categorically reject it.
